CONTRACTUAL TERMS

Terms and Conditions – Porta Solis

For property presentations, partner packages and digital services provided by Porta Solis.

Translation of the German version · Updated: 23 September 2026

These terms concern Porta Solis’s own services. Booking and rental terms for a property and the terms of individual service providers are separate documents.

1. Provider and scope

The contracting party for Porta Solis’s own services is:

Aleksandra Drežančić, trading as Porta Solis
Joachimsthaler Str. 4
91126 Schwabach, Germany
Email: info@portasolis.com
VAT identification number: DE263017809

These Terms and Conditions apply to contracts for property presentations, partner presentations, digital guest guides and agreed supplementary platform services, insofar as they were validly incorporated before the contract was concluded. Individual agreements take precedence. Publication of this version does not retrospectively amend existing contracts.

Partner packages are intended for businesses and providers acting professionally or commercially. Hosts, however, may be businesses or consumers. The purpose of the particular transaction is decisive; the label “private landlord” or creation of a host account does not determine this on its own.

2. Role of the platform

Porta Solis operates a presentation, contact and digital service platform. For the holiday properties displayed, Porta Solis is generally neither the landlord nor a party to the accommodation or rental contract. That contract is concluded between the guest and the identified host or provider. An exception applies only where Porta Solis expressly acts as the provider of the service concerned in the specific offer.

Services offered by service partners are also provided by those partners themselves. Presentation, recommendation, contact facilitation or technical transmission of an enquiry does not make Porta Solis a contracting party for the accommodation, goods or service concerned.

The commission-free property presentation model means that Porta Solis does not charge referral commission on accommodation bookings made through that model. The agreed prices for Porta Solis’s own packages and modules remain unaffected. Labelled affiliate offers from external travel providers are separate offers.

3. Enquiries, orders and conclusion of contracts

General contact enquiries, partner enquiries and requests for an individual quote are non-binding. Submitting a partner enquiry does not yet create a paid contract. Neither registration nor saving a guest guide draft constitutes a paid order on its own.

Submitting a property for review transmits the property details and the desired presentation package. Reviewing or saving those details does not replace an agreement on the paid service.

A final step expressly identified as a paid order or commission – such as “Order a guest guide with an obligation to pay” or a paid last-minute order – is, by contrast, a declaration directed at concluding a contract for payment. The services, prices and terms previously displayed and agreed are decisive. A contract requires matching declarations by both parties. A technical acknowledgement of receipt or the status “requested” is not, by itself, a declaration of acceptance.

For a separate offer, acceptance is governed by that offer. These Terms and Conditions do not establish special acceptance periods, a different contracting mechanism or additional charges. Changes to an already agreed order require a corresponding agreement.

Entries should be checked before submission and corrected using the available editing steps. These Terms and Conditions can be retained using the browser’s print and save functions. Also retain the specific offer, order summary and contract confirmation. Unchanged subsequent access to all contractual declarations in the user account is not promised.

4. Prices, VAT and payment

Charges apply to expressly agreed packages, add-on modules and other services. The price agreed when the contract is concluded is decisive. The published package prices listed below are net prices in euros, plus legally applicable VAT. For consumers, the actual total price payable, including applicable taxes, is decisive before a binding contract is concluded.

Special VAT treatment, such as reverse charge where the statutory requirements are met, requires the necessary information and evidence. A foreign address alone does not establish entitlement to that treatment.

The payment method and payment date are governed by the specific agreement. An invoice records the remuneration owed; it does not create additional services or charges that were not previously agreed. Where there is no valid agreement on the due date, statutory provisions apply. These Terms and Conditions introduce no new general payment deadline.

Last-minute presentations are paid by bank transfer against an invoice and activated only after confirmed receipt of payment and a separate review. Other payment methods apply to Porta Solis’s own services only if offered and agreed in the particular order.

5. Property presentations

The published presentation packages have the following prices and terms:

  • Starter: €39 excluding VAT for 3 months, 1 unit.
  • Standard: €75 excluding VAT for 6 months, up to 3 units.
  • Annual package: €139 excluding VAT for 12 months, up to 5 units.
  • Plus: €199 excluding VAT for 18 months, up to 7 units.
  • Premium: €249 excluding VAT for 24 months, up to 10 units.

Additional properties beyond the scope of the purchased package cannot currently be added online. Please contact Porta Solis. Any extension, its scope and price require a separate agreement.

The presentation includes the agreed profile display and the information and contact options provided for it. This may include property descriptions, images, amenities, contact details, website and booking links, and email or WhatsApp contact. Availability calendars and iCal links are used only to the extent actually provided. They do not replace the host’s verification of availability.

Highlighted placements, homepage rotation, additional digital guest features, editorial content or social media services are owed only insofar as expressly agreed for the specific package. A highlighted or rotating display does not mean a permanent first position.

Porta Solis owes the agreed presentation service, but not a particular number of bookings, enquiries or visitors, a particular search engine ranking or a particular level of revenue. Agreed services and statutory rights in the event of non-performance remain unaffected.

6. Hosts’ obligations

Hosts must keep property details, prices, availability, amenities, descriptions and contact details accurate and up to date. They must be authorised to let the property and use the submitted images, texts and other content.

They are responsible for the accommodation service, necessary permits, tax obligations and local reporting and registration requirements. Digital data collection or export functions replace neither required reporting to an authority nor its verification.

Unlawful or misleading information, or information infringing third-party rights, is prohibited. Changes materially affecting the agreed presentation or its lawfulness must be corrected promptly or notified to Porta Solis.

7. Partner packages and presentation

The standard packages published on “Become a partner” are intended for businesses:

Partner Basic – €99 excluding VAT per year

Partner profile in the directory, assignment to an industry, country and region, business description, contact details and website link.

Partner Plus – €199 excluding VAT per year

Basic services plus a logo or business image, a more detailed business presentation, display of multiple services, additional contact options and enhanced design.

Partner Premium – €349 excluding VAT per year

Plus services plus a Premium seal, display in “Recommended partners”, highlighting in relevant filters, multiple regions and an expanded presentation. Recommended partners rotate within relevant regions and categories. A permanent top position or appearance in every search is not promised.

Alternatively, monthly payments of €9.90 excluding VAT for Basic, €19.90 for Plus or €34.90 for Premium are offered with a minimum term of 12 months. This totals €118.80, €238.80 or €418.80 excluding VAT respectively over 12 months. Monthly payment therefore does not mean a contract cancellable monthly and is not the same as the calculated monthly comparison of the lower annual price.

The inclusion of Premium partners in selected digital guest guides depends on their services, area of operation and the approval of the respective host. Automatic display in all guest guides is not included. Individual collaborations apply only to the extent expressly agreed.

The service consists of the agreed business presentation. No particular number of clicks, customers, enquiries, reservations or sales, or level of revenue, is guaranteed.

8. Partner information

Partners are responsible for their business information, prices, offers, services, opening hours, contacts, images and logos. They must hold necessary business authorisations and permits and must not infringe third parties’ image, text or trademark rights.

Approval of a profile by Porta Solis is not a guarantee of the quality, authorisation or continuous availability of all partner services. Reports of incorrect or unlawful content are reviewed; any measures are governed by the principles in section 15.

9. Digital guest guide and add-on modules

Porta Solis provides the agreed technical guest guide. The published setup offer includes setup, a guest link, a QR code, one round of revisions and the first year of provision:

  • 1 property: €149 excluding VAT as a one-off payment; where continued use is agreed, €49 excluding VAT per year from the second year.
  • 2–3 apartments or residential units: €249 excluding VAT as a one-off payment; continued use €79 excluding VAT per year.
  • 4–6 apartments or residential units: €349 excluding VAT as a one-off payment; continued use €109 excluding VAT per year.
  • Larger complexes: individual quote.

Optional services include service enquiries for a one-off €49 excluding VAT, a guest shop with up to 3 offers for a one-off €79 excluding VAT, or up to 8 offers for a one-off €129 excluding VAT. With the latter option, each additional offer beyond 8 costs a one-off €15 excluding VAT. Activation depends on the modules ordered.

The guest guide may contain property and Wi-Fi information, check-in and check-out details, contact and emergency information, recommendations and personal guest access. Further functions such as service and shop enquiries, orders, damage reports, contractual documents, payment information or push notifications are included only within the agreed and available scope of functionality. Push notifications also require supported devices, browsers and, where applicable, the recipient’s consent.

Hosts are responsible for the content provided and the lawful use of guests’ personal data. Personal access and private documents may be made available only to authorised persons. Contract templates and document functions do not replace a legal review of the host’s terms tailored to the individual case.

10. Guest offers, orders and payments

Where a host or partner offers their own goods or services through the guest guide, they remain the provider. The corresponding contract is concluded between the guest and that provider. The provider is responsible for prices, mandatory information, availability, acceptance of an order, performance, delivery and any unwinding of the transaction.

Service, shop, accommodation or rebooking enquiries marked as non-binding do not alone constitute a binding reservation. For a binding offer, its contracting terms and the declarations actually made are decisive. Technical forwarding by Porta Solis does not itself constitute acceptance by the provider.

Guests pay the respective provider directly, for example on site, in cash, by bank transfer or through an external payment link supplied by the provider. Porta Solis does not receive these guest payments itself and does not store full credit card details or card verification numbers. For external payment services, their terms apply within the respective contractual relationship.

A payment or deposit status recorded in the host account is information supplied by the host, not an automatic payment confirmation by Porta Solis. A damage report or documented claim does not, by itself, trigger payment or retention of a deposit.

11. Last-minute presentation

Additional last-minute promotion is offered at €19 net per accommodation for up to 30 days from actual activation. It requires a published listing, confirmed receipt of payment and administrative approval.

If the stated available travel period or a self-selected advertisement end date ends earlier, the public display ends correspondingly earlier. The display is not a booking commitment or a guarantee that the available period will be rented. No automatic follow-up order is triggered.

12. Commencement, term and termination

The specific commencement of the service follows from the particular agreement. Registration, data entry, ordering, activation and publication are separate steps. Last-minute presentations begin from actual activation as expressly provided.

Property presentations are offered for the terms stated in section 5 without automatic renewal. The digital guest guide also does not renew automatically; continued use after the first year is discussed and agreed in advance.

Annual prices are published for partner packages, with a minimum term of 12 months for monthly payment. The specific commencement and provisions on termination or subsequent continuation must be stated in the respective partner offer. These Terms and Conditions establish neither an additional automatic renewal nor a new notice period for this purpose.

For a validly agreed fixed term without automatic renewal, no precautionary cancellation is required to prevent renewal. Rights to early termination, particularly for good cause, and statutory consumer rights remain in force. Declarations may in particular be sent by email to info@portasolis.com; other legally prescribed means of making declarations remain unaffected.

Refunds and outstanding fees upon early termination are governed by the specific contract and statutory provisions. Neither a blanket exclusion of all refunds nor an unconditional repayment of all fees is agreed.

After the contract ends, the public presentation or agreed guest access may be deactivated. Statutory rights to handover, access and data remain in force. Contract and billing data continue to be processed to the extent necessary in accordance with retention obligations and the privacy policy (German) .

13. Consumer rights

These Terms and Conditions do not classify all private hosts as businesses. If they act as consumers in the particular contract, the applicable statutory protections remain fully in force.

Agreeing to these Terms and Conditions does not exclude a statutory right of withdrawal. Required information and withdrawal instructions appropriate to the specific contract must be provided separately before a binding contract is concluded. These Terms and Conditions contain neither blanket withdrawal instructions nor consent to early commencement of performance or expiry of a right of withdrawal.

The exception for certain time-specific accommodation bookings must not automatically be applied to a separate presentation or digital service contract with Porta Solis. Statutory rights relating to digital products, including necessary updates, remain unaffected.

14. Technology, maintenance and further development

Browser-based functions require a suitable up-to-date browser and an internet connection. Uninterrupted, technically fault-free operation or a fixed availability rate is not promised. This does not remove Porta Solis’s obligation to provide the agreed service in accordance with the contract and address disruptions within its own area of responsibility.

Necessary maintenance and security measures may cause temporary restrictions. Significant foreseeable restrictions are communicated in advance where possible and limited to what is necessary.

Further developments must not arbitrarily withdraw agreed core services. Material contractual changes require a valid basis; mandatory rights to information, consent and termination, particularly for digital consumer services, remain in force.

In the event of unforeseeable circumstances beyond control, affected parties are informed of material effects and reasonable remedial measures are considered. Force majeure does not create a blanket exclusion of refund, termination or other statutory rights.

15. Account security, permitted use and measures

Access credentials must be kept confidential and protected against unauthorised use. Suspected misuse should be reported to Porta Solis without delay. In particular, unlawful content, deception, malware, unauthorised access to others’ data and abusive disruption of the platform are prohibited.

After review, Porta Solis may reject or remove unlawful or manifestly false content and appropriately restrict affected functions for specific security or misuse reasons. Measures must take account of the cause, seriousness and effects; correction must be allowed where sufficient.

Affected parties receive reasons and an opportunity to clarify matters, unless prohibited by law or prevented by urgent security reasons. Legally required reasons, time limits and complaint options remain unaffected. Final termination of a contract requires an appropriate contractual or statutory basis.

16. Rights to images, texts and logos

Rights to submitted content remain with the rights holders. Hosts and partners grant Porta Solis a non-exclusive right of use only to the extent necessary for the agreed publication and provision of services. This includes technical storage, reproduction, public display and necessary format or size adjustments.

Use for social media, additional advertising or editorial presentations is included only insofar as agreed. No further transfer of rights or unrestricted commercial exploitation by third parties takes place. Necessary technical service providers may be involved only within the scope of service provision.

After the agreed use ends, the basis for further public presentations ceases; legally required retention and evidence remain permissible. Statutory rights to content and data remain unaffected.

17. Responsibility and liability

Porta Solis is liable for breaches of obligations in its own services in accordance with statutory provisions. These Terms and Conditions do not, in particular, exclude liability for intent, gross negligence, injury to life, body or health, or other mandatory liability.

Information and services provided by hosts and partners are generally attributable to them. This leaves Porta Solis’s own statutory duties of review, response or other obligations unaffected. There is no blanket exclusion of liability for external links either; the identified provider is responsible for the services offered there, while any responsibility of Porta Solis itself is assessed under the statutory requirements.

The absence of a promise of booking or revenue results does not remove claims arising from non-performance or defective performance of agreed platform services.

18. Communication and final provisions

Contract administration may take place electronically, particularly by email and through available account functions. Contractually relevant communications must be distinguished from non-binding status displays. Please notify us of changes to your required contact and billing details.

The original version is written in German. Croatian and English translations are available using the language selector on this page.

Statutory rules on applicable law and jurisdiction apply. These Terms and Conditions do not establish an exclusive place of jurisdiction for consumers. If a provision is invalid, its replacement is governed by statutory provisions; the remaining provisions continue to apply to the extent provided by law.

Porta Solis is neither willing nor obliged to participate in dispute resolution proceedings before a consumer arbitration body.
